EMPLOYMENT AT WILL
New York is an “employment at will” state. That means that your boss can fire you at any
time for almost any reason, just like you can quit your job at any time for any reason. It is
perfectly legal for your boss to fire you because he doesn’t like you, just as it is perfectly legal
for you to quit your job because you don’t like your boss.
There are some illegal reasons for firing someone. If you were fired because of your age,
sex, race, citizenship, disability, religion, sexual orientation, ethnic background, or pregnancy,
that is discrimination and your boss may have broken the law (for more information, see page 5
of this booklet). You also cannot be fired because you did something that the law gives you the
right to do. For example, you cannot legally be fired because you reported a health and safety
violation to OSHA or took time off to care for your sick child.
